Terms of Service
The agreement between you and Monfly. Using Monfly means you accept it, so please read it.
In short
- Monfly is a record-keeping tool. It isn’t a bank, it never moves your money and it doesn’t connect to your accounts.
- Nothing in Monfly is financial, tax or legal advice.
- Its figures come from what you enter. Check them against your bank.
- What you enter is yours, and you can ask us to delete it at any time.
- Monfly is provided as is, and these terms are governed by the laws of Mexico.
This agreement
Monfly is a personal finance app operated by Luis Alvarez, in Mexico (“Monfly”, “we”, “us”). These Terms of Service (the “Terms”) are an agreement between you and us about your use of the Monfly website, the web app and the installable app (together, the “Service”).
By creating an account, signing in or otherwise using the Service, you accept these Terms and our Privacy Policy. If you don’t accept them, don’t use the Service.
What Monfly is, and isn’t
Monfly helps you keep a record of your money: your accounts, transactions, transfers, budgets and loans, and the figures, charts and statements drawn from them.
Monfly is not a bank, financial institution, payment service, money transmitter, lender, credit bureau or investment adviser, and it isn’t supervised by any financial authority. In particular:
- Monfly never holds, sends, receives or moves money. A “transfer” or a loan “payment” recorded in Monfly is an entry in your records, not a movement of funds.
- Monfly doesn’t connect to your bank, your cards or any financial account, and it never asks for your banking passwords or card numbers.
- Loans in Monfly are notes you keep about money lent or borrowed between you and other people. Monfly isn’t a party to them, and doesn’t enforce or collect them.
No financial advice
Budgets, limits, insights, “what-if” scenarios, statements and everything else the Service shows are for information only. They are not financial, investment, tax, accounting or legal advice, and they are not a recommendation to do anything. Decisions about your money are yours. For advice about your own situation, talk to a qualified professional.
Your figures
Every figure in Monfly is worked out from the information you enter, so it can only be as accurate and complete as that information. Rounding, currency formats, the time zone months are drawn in and mistakes in entry can all make a figure differ from your bank’s. We don’t guarantee that any figure, balance, total or chart is accurate, complete or current.
Check what matters against the statements of your bank or card issuer, and don’t use Monfly as your only record of your finances, or to meet a legal, tax or accounting obligation.
Monfly doesn’t remind you of due dates or payments. A missed payment, and any fee, interest or penalty that follows, isn’t our responsibility.
Your account
- You must be at least 18 years old, and able to enter into a binding agreement.
- Give accurate information when you sign up, and keep it up to date.
- Sign-in is provided by Auth0. Keep your sign-in details private: you’re responsible for everything done through your account. If you think someone else has used it, tell us straight away at mrluisfeer@gmail.com.
- An account is for one person, and it can’t be transferred.
What you enter
What you enter in Monfly (your “Content”) stays yours. You give us a non-exclusive, worldwide, royalty-free permission to store, copy, process and display your Content only as needed to provide, secure and improve the Service for you, as the Privacy Policy describes. This permission ends when your Content is deleted, apart from copies that remain for a limited time in backups.
You’re responsible for your Content and for having the right to enter it. When you record information about someone else, such as the name of the person in a loan, keep it to what you need and make sure you’re allowed to. Don’t enter card numbers, passwords, government identification numbers or health information: Monfly doesn’t need them.
Acceptable use
You agree not to:
- use the Service for anything unlawful, including fraud, money laundering or financing illegal activity;
- access, or try to access, anyone else’s account or data;
- probe, scan or test the Service’s security, get around it, or interfere with how the Service runs, for example by overloading it;
- copy, scrape, reverse engineer, resell or build a competing product from the Service or any part of it, except as the law expressly allows;
- reach the Service by automated means other than the ones we provide;
- upload malicious code, or anything that infringes someone else’s rights.
We may suspend or close an account that breaks these rules, or when we need to in order to protect the Service, other people or ourselves, or to comply with the law.
Availability and changes
We work to keep Monfly running, but we don’t promise it will always be available, or free of errors or interruptions. We may change, add or remove features, carry out maintenance, or suspend or stop the Service, in whole or in part, at any time. Where we reasonably can, we’ll give notice before stopping the Service entirely, so you can take a copy of your records.
While you’re offline, the installed app may show what it last loaded. Data can be lost through faults beyond our control, so keep your own copy of anything that matters to you, for example the statement you can download from Insights.
Price
Monfly doesn’t charge for the Service today. If we ever introduce paid features, we’ll tell you the price and terms before anything is charged, and nothing will be charged without your agreement.
Our rights
The Service, including its software, design, text, and the Monfly name and logo, belongs to Luis Alvarez and is protected by intellectual property law. These Terms give you a personal, limited, non-exclusive, non-transferable and revocable right to use the Service for your own finances, and no other right in it. If you send us ideas or feedback, we may use them freely, with no obligation to you.
Other services
Parts of the Service rely on other companies, such as our sign-in, hosting and database providers. Their own terms apply to their services, and we aren’t responsible for them. Links to other sites are there for convenience; we don’t control those sites.
Ending this agreement
You can stop using Monfly at any time, and ask us to delete your account by writing to mrluisfeer@gmail.com. We may suspend or end your access as described above. When your account ends, so does your right to use the Service, and your Content is deleted as the Privacy Policy describes.
The parts of these Terms that by their nature should last, including those on your figures, warranties, liability, indemnity and governing law, continue to apply after they end.
No warranties
To the fullest extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability and non-infringement. Where a law doesn’t allow a warranty to be excluded, that exclusion doesn’t apply to you.
Limitation of liability
To the fullest extent the law allows:
- neither Luis Alvarez nor anyone who helps provide the Service will be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, income, savings, data, opportunity or goodwill;
- nor for losses arising from decisions you make using the Service, from inaccurate or incomplete figures, from missed payments or due dates and any fee, interest or penalty that follows, from access to your account that isn’t our fault, or from events beyond our reasonable control;
- and our total liability for all claims relating to the Service is limited to the amount you paid us for it in the twelve months before the event that gave rise to the claim.
Nothing in these Terms limits liability that can’t be limited under the applicable law, such as liability for fraud or wilful misconduct, or rights you have as a consumer that can’t be waived.
Indemnity
You agree to hold Luis Alvarez harmless from any claim, loss or expense, including reasonable legal fees, arising from your Content, your use of the Service, or your breach of these Terms or of anyone’s rights.
Changes to these terms
We may update these Terms. We’ll publish the new version here with its date and, for significant changes, tell you in the Service or by email before they take effect. If you keep using the Service after that, you accept the new Terms; if you don’t, stop using it and ask us to delete your account.
Governing law
These Terms are governed by the federal laws of the United Mexican States. Any dispute about them or the Service will be resolved by the competent courts of Mexico, and you and we waive any other jurisdiction that might apply because of a present or future domicile or for any other reason.
This doesn’t take away any right you have under the Ley Federal de Protección al Consumidor, including going to the Procuraduría Federal del Consumidor (PROFECO).
General
These Terms and the Privacy Policy are the whole agreement between you and us about the Service. If a part of them is found unenforceable, the rest stays in effect, and not enforcing a part isn’t a waiver of it. You can’t transfer your rights under these Terms; we may transfer ours together with the Service. These Terms are written in English, and if a translation we provide differs, the English version prevails.
